Right-wing radio host and conspiracy theorist Alex Jones is moving to dismiss a defamation lawsuit filed by the families of some of the 26 people killed in the 2012 Sandy Hook school shooting.

In written arguments filed Friday, Jones’ lawyers argue he was acting as a journalist in the tradition of Bob Woodward and Carl Bernstein in questioning the official narrative of the Connecticut shooting.

Jones, who says he now believes the shootings happened, says such journalism would be chilled if “reporters were subject to liability if they turned out to be wrong.”

A mere matter of days after InfoWars founder Alex Jones received yet another YouTube strike — but wasn’t banned — he’s been hit with a 30-day block on Facebook. Jones received another strike on YouTube this week for violating community guidelines in four videos, which have since been taken down.

A Facebook spokesperson confirmed in an email that the social network has enforced a 30-day time out for Jones after he was found to have violated Facebook’s Community Standards. So, what exactly is a 30-day block? Essentially, the block will be applied to any pages managed by Jones, in addition to Jones himself. This means he won’t be able to post content to any pages that he’s “page admin” for.

Facebook enforce 30-day bans in the case of multiple violations. Prior to this ban, Jones has received a notification from Facebook informing him that he had repeatedly violated its policies and informing him that if he did so again, he’d receive a 30-day ban.

Infowars founder and conspiracy-theory aficionado Alex Jones is reportedly seeking more than $100,000 in court costs from a Sandy Hook family suing him for defamation. A hearing will begin Wednesday in the lawsuit filed by Veronique De La Rosa and Leonard Pozner, a couple who lost their 6-year-old son in the Sandy Hook Elementary school shooting in December 2012.

In court filings submitted ahead of trial this week, Jones and his lawyers argue the Pozner family’s lawsuit aims “to silence those who openly oppose their very public ‘herculean’ efforts to ban the sale of certain weapons, ammunition, and accessories, to pass new laws relating to gun registration and to limit free speech.”

The New York Times reports:

In the five years since Noah Pozner was killed at Sandy Hook Elementary School in Newtown, Conn., death threats and online harassment have forced his parents, Veronique De La Rosa and Leonard Pozner, to relocate seven times. They now live in a high-security community hundreds of miles from where their 6-year-old is buried.

“I would love to go see my son’s grave and I don’t get to do that, but we made the right decision,” Ms. De La Rosa said in a recent interview. Each time they have moved, online fabulists stalking the family have published their whereabouts. “With the speed of light,” she said. “They have their own community, and they have the ear of some very powerful people.”

The day after the Pozner case, in the same courthouse, is a hearing in a separate defamation case against Mr. Jones brought by Marcel Fontaine, who was falsely identified on Infowars’ website as the gunman in the Parkland, Fla., school shooting in February. Mr. Fontaine, who lives in Massachusetts, has never visited Florida.

YouTube has removed Alex Jones’ page, following bans earlier Monday from Apple and Facebook. The Alex Jones Channel, which counts 2.4 million subscribers, still appeared in YouTube search results by midday Monday, but presented only a take-down notice when users clicked in.

“This account has been terminated for violating YouTube’s Community Guidelines,” the notice says. YouTube counts “strikes” against pages for posts that violate the company’s policies. Jones received a strike in July when he posted four videos that violated YouTube policies against child endangerment and hate speech, the company said in a statement to CNBC.

A page with one strike against it is suspended from live streaming for 90 days, YouTube said, but Jones attempted to circumvent the suspension by live streaming on other channels. As a result, his page was terminated, the company said.

Former Maricopa County Sheriff Joe Arpaio, who is running as a Republican for a U.S. Senate seat in Arizona, told his campaign to “stand up” for conspiracy theorist Alex Jones after several social media companies banned Jones from their platforms. Dustin Stockton, a senior Arpaio strategist, wrote on Twitter that Arpaio has directed the campaign to look into purchasing advertising on Jones’ Infowars outlet “to help provide resources as they fight for free speech.”

Shortly before the pardon was officially announced in August 2017, Arpaio appeared on Jones’ show and credited Infowars with bringing his case to Trump’s attention, saying, “I want to thank you, Alex, and your staff, Jerry Corsi, Roger Stone, for bringing this story out and reaching the president. I supported him from, what, two years ago at the same forum that he did yesterday and I’m with him and I’m with him to the end.”

The New York Times reports:

Twitter on Tuesday suspended the account of the far-right conspiracy theorist Alex Jones for a week after he tweeted a link to a video calling for supporters to get their “battle rifles” ready against media and others, in a violation of the company’s rules against inciting violence.

The action effectively prevents Mr. Jones from tweeting or retweeting from his personal account for seven days, though he will be able to browse Twitter. The Twitter account for Infowars, the media website founded by Mr. Jones, was not affected.

The Guardian reports:

The move by the last remaining high-profile social network from which Jones has yet to be permanently banned, comes after a tumultuous period in which Twitter’s chief executive Jack Dorsey has had to repeatedly defend the company’s position.

Facebook, YouTube, Spotify and Apple banned Jones’s accounts and products from their various services on 6 August following the media backlash. Jones’s apps still remain available via Apple’s App Store and Google’s Play store, however.

Lawyers for the families of two Sandy Hook shooting victims are accusing the conspiracy theorist Alex Jones and his Infowars media business of intentionally destroying evidence relevant to the defamation cases against him, according to a motion filed on Friday in a Texas court.

Mr. Jones had been informed in writing in April that he was obligated by law to preserve all relevant material, according to the court filing in District Court in Travis County in Austin. “As pressure mounted from pending defamation lawsuits and growing public indignation, Mr. Jones chose to destroy evidence of his actual malice and defamatory conduct,” the motion filed on Friday said. “Infowars deleted critical evidence at the precise moment plaintiff and his experts were attempting to marshal that evidence.”

Friday’s motion is the latest legal salvo in three separate defamation lawsuits filed by Sandy Hook families, which seek tens of millions of dollars in damages and pose an existential threat to Mr. Jones’s business. The material that was destroyed could be presumed by the court as supporting Mr. Heslin’s claims against Mr. Jones, bolstering his case.

Infowars founder Alex Jones and his lawyer, Norm Pattis, say the conspiracy theory aficionado was the target of a malware attack that left child pornography embedded on his servers, a move which they say sparked an FBI investigation.

With Pattis by his side on his show Friday, Jones exploded into a five-minute rant before announcing he would fork over $1 million to whoever finds the culprit.

“You’re trying to set me up with child porn, I’m going to get your ass. One million dollars, one million dollars you little gang member. One million dollars to put your head on a pike. One million dollars, bitch,” Jones shouted, adding, “You’re not going to ever defeat Texas, you sacks of shit.”

As you’ll see in the clip, Jones suggests that Sandy Hook parents and Democrats planted the child porn, which supposedly came as email attachments.

Earlier this week a Connecticut judge ordered Jones to turn over detailed financial records in the suit brought by the Sandy Hook parents.

InfoWars host Alex Jones filed a lawsuit on Wednesday in the U.S. District Court for the Western District of Texas, accusing The Young Turks–a progressive online news show–and Brianna Wu–a Massachusetts Democrat running for the House of Representatives–of libeling the plaintiff.

The defamation lawsuit focuses on the false claim that Jones “sent child porn to Sandy Hook parents.”

As Law & Crime reported before, lawyers representing families of Sandy Hook mass shooting victims in a defamation suit accused Jones of sending electronic files containing child pornography as part of the discovery process.
